The LNG terminals operated by DET are classified as critical infrastructure (KRITIS). These are facilities whose protection is essential to the public good and to the security of supply. An official no-fly zone for drones and unmanned aircraft applies in the immediate vicinity of the terminals.
Legal basis
The no-fly zone is based on Section 21h of the German Air Traffic Regulations (Luftverkehrs-Ordnung, LuftVO). This provision establishes nationwide that operating unmanned aircraft over and near particularly sensitive facilities, including hospitals, power plants and energy supply installations such as LNG terminals, is prohibited, permitted only under restrictions, or allowed only with express authorisation.
Consequences of violations
Violations of the flight restrictions are consistently pursued by the competent enforcement and prosecution authorities. Entering the no-fly zone without authorisation generally constitutes an administrative offence and can be punished with a fine. Depending on the individual case, for example where the facility or air traffic is specifically endangered, criminal penalties may also apply.
